- In accordance with NY State regulations, open fire burning is prohibited during burn bans. However, small backyard fire pits are permitted only if they are never left unattended. Guests must remain with the fire pit at all times while it is in use and ensure it is fully extinguished before leaving. The fire must not exceed 3 feet in height or diameter.
