VACATION RENTAL AGREEMENT & LIABILITY WAIVER
(NC Vacation Rental Act, G.S. § 42A)
NC STATUTORY NOTICE: THIS IS A VACATION RENTAL AGREEMENT UNDER THE NC VACATION RENTAL ACT. RIGHTS/OBLIGATIONS ARE DEFINED BY LAW, INCLUDING PRE-TENANCY RENT DISBURSEMENT AND EXPEDITED EVICTION. SIGNATURE, PAYMENT, OR POSSESSION EVIDENCES ACCEPTANCE AND INTENT TO USE PROPERTY FOR VACATION RENTAL.
1. DETAILS & PARTIES: Agreement between hosts/owners ("Host") and primary guest ("Guest"). Dates, times, names, and occupancy counts are incorporated directly from the booking platform (Airbnb, Vrbo, Hostfully).
2. FINANCIALS: Guest pays total amount (rent, cleaning, admin, pet fees, taxes) on platform invoice.
3. DEPOSIT & DAMAGE: Holds/deposits process via platform. Guest is fully responsible for property and authorizes Host to charge the card on file, use platform protection, or deduct from deposit for damages, missing items, utility abuse, or fines.
4. CANCELLATION & CHARGEBACKS: Policy is Firm per listing. If completely uninhabitable before check-in, Host will seek a comparable property or issue a prorated refund. No refunds for early departures, voluntary cancellations, or weather. Refunds follow firm policy minus 6% processing fee. Guest agrees terms are fair and waives rights to credit card chargebacks for issues covered here or by platform terms.
5. PLATFORM INTEGRATION: Incorporates all platform terms. Guest waives right to dispute legitimate charges with credit card company for issues covered under this agreement or platform terms.
6. EXPEDITED EVICTION: For tenancies ≤30 days, Article 4 eviction applies. Host may evict if Guest holds over, materially breaches agreement/rules, fails to pay, or obtains possession by fraud.
7. EVACUATION: Guest must comply with mandatory evacuation orders (G.S. § 42A-36). No refunds if travel insurance was offered prior to booking.
8. OCCUPANCY: Strictly limited to invoice guest count. Registered guests only. Unauthorized parties/gatherings cause immediate termination, eviction, and money forfeiture.
9. HOUSE RULES: Follow platform rules, property binder, and neighborhood guidelines. No smoking/vaping inside or on decks. Quiet hours apply per binder. Parking in designated spaces only; do not park on grass or block mountain roads. Pets allowed only if explicitly approved on reservation and paid for. Unapproved pets result in a fine and immediate eviction.
10. UTILITIES & ACCESS: Private well/septic system. Practice conservative water use (heavy concurrent use from showers, laundry, and dishwasher can outpace pump). Flush only septic-safe toilet paper; no feminine products, wipes, paper towels, or grease. Guest liable for repairs from improper use. Mountain terrain; 4WD/AWD highly recommended in winter. Host not liable for weather delays, road closures, or towing.
11. AMENITIES: Covered 6-person hot tub used at Guest’s own risk; adult supervision required. Limit exposure; no alcohol. No refunds for mechanical failure. Use hot tub towels. Fire pit/gas fireplace require extreme caution; check burn bans, never leave unattended, and extinguish outdoor fires fully with water. Guest assumes all financial/legal liability for damage, wildfires, or injuries. Game tables/arcades used at own risk.
12. CAMERAS: Exterior cameras monitor access points/driveway. None inside or in private outdoor areas. Tampering causes immediate eviction and deposit forfeiture.
13. NATURAL CONDITIONS: Rural, high-elevation environment. Guest assumes all risks (steep/uneven terrain, slippery decks, wildlife, insects, spiders, bears). Host not liable for native Western NC elements.
14. MAINTENANCE & ENTRY: Report defects/breakdowns immediately. Host/contractors may enter at reasonable times for emergencies, repairs, or inspections.
15. LIABILITY LIMITS: Guest releases Host/Owners from all liability for injury, slips/falls, illness, death, or property damage, and indemnifies Host/Owners against party member claims resulting from negligence or rule violations.
16. PROPERTY SALE: If sold, managed per G.S. § 42A-19. Transferees take subject to reservations ending within 180 days of recordation.
17. VENUE: Governed by NC law. All disputes, mediation, or lawsuits must be handled exclusively in Haywood County, NC.
18. LEGAL ACCEPTANCE: Under G.S. § 42A-11, binding once received and Guest either: (1) signs digitally/physically, (2) makes any payment, or (3) takes physical possession by checking in.

House Rules & Policies 📋
• Pet-Friendly: $150 non-refundable fee. Max 50 lbs, 1+ year old, and spayed/neutered. 🐕
• Hot Tub Policy: Our goal is for the hot tub to be available for every guest. However, refunds cannot be provided for mechanical issues that prevent its use. 🫧
• Septic System: Please only flush provided septic-safe toilet paper to protect the mountain plumbing. 🧻
